Service Agreement and Terms of Service
Last updated 2 October 2026 · version 2026-10-02-v1
The short version
- You get to use BossHours to run your own business. We keep owning the software, the designs and everything we built.
- Your customers, jobs, prices and records are yours. We never sell them, and you can ask for a copy or deletion.
- Please do not copy it, take it apart, scrape it, record the demos, share your login, or build a competing product from it.
- The demos use made-up companies and made-up people. Nothing in a demo is real advice or a real customer.
- You can cancel any time. What you owe, and what is included each month, is shown to you before you pay.
The full wording below is what counts if anything is ever in dispute.
1. Who we are and what this covers
“We,” “us” and “BossHours” mean BossHours, LLC, a Florida limited liability company, which runs this service. “You” means the person or business that watches a demo, starts a free trial or subscribes. This agreement covers the demos, the free trial, the paid service, our website and anything we send you.
By ticking the box and continuing, you agree to this agreement. If you are agreeing for a business, you confirm you can bind it.
2. What you get
Access to the BossHours software for your trade: jobs, estimates, invoices, customers, scheduling, the booking page, and the other tools shown in the demo. Features can improve or change over time. We may fix or remove a feature if we have to, and we will not remove something you rely on without good reason and fair notice.
3. Demos and the free trial
Demos use invented companies and invented data and are shown only so you can judge the product. A free trial gives you your own copy to try for the period we state when you start it. At the end of the trial, if you have not subscribed, your copy becomes read-only and is deleted after the grace period we tell you about. We may refuse or end a trial that looks like abuse, for example many trials from one person.
4. Paying, onboarding and what is included
4A. Onboarding. There is no setup fee. Your plan includes help getting you running: your company details, your price list, bringing in recent customers and invoices, your team and your first 30 days of onboarding help. Older history and work beyond that scope can be brought in by you with our import tools, or quoted separately. Small changes to how the software works for you that come up in your first weeks are made as part of onboarding where we reasonably can.
4B. Included usage. Your monthly price includes a monthly amount of AI actions, phone minutes and text messages, shown to you inside the app. Going over is charged at the rates shown there. You can set a spending limit, we warn you before you reach it, and when you reach it the metered features pause rather than keep charging you.
4C. Prices and billing. The monthly price and any add-ons are shown to you before you pay, and you pay them through our payment provider. We will tell you before a price changes, and a change never applies to a month you have already paid for. Taxes are added where required.
4D. Cancelling. You can cancel any time. You keep access to the end of the period you paid for. We do not pro-rate partial months unless the law says we must.
5. Your data
Your customers, jobs, prices, photos and records are yours. You give us permission to store and process them only to run the service for you, keep it safe and make backups. We never sell your data. How we handle personal information is explained on the privacy page. You are responsible for having the right to enter your customers’ information. You can ask for an export or deletion of your data and we will do it within a reasonable time.
6. What stays ours (intellectual property)
The software, its screens, designs, code, text, templates, price-list structures, videos, demos, trade research, names, logos and everything else that makes up BossHours belong to BossHours and our licensors, now and in the future. Using the service gives you a license to use it, never ownership of any part of it.
Your license. We give you a limited, non-exclusive, non-transferable license, which we can revoke if you break this agreement, to use the service for your own business while your access is active.
7. What you agree not to do
- Copy, reproduce, resell or sublicense any part of the service.
- Reverse engineer, decompile or try to get at the source code, database structure or how it works.
- Scrape, crawl or bulk-download pages, screens, data or content by any automated means.
- Build, train or help build a competing product or service using what you learn from ours.
- Share your login with anyone outside your business, or let people who are not on your team use it.
- Screen-record, screenshot for publication, or share the demos or trial screens with people outside your business, other than a short quote or clip for a genuine review.
- Try to get around the security, the trial limits or the usage limits, or probe the service for weaknesses.
- Use the service to break the law or to harm other people.
8. Confidential information
Everything non-public that you see in the demos, the trial or the service — how it works, how it is built, unreleased features, pricing we show you privately — is confidential to BossHours. You agree to keep it confidential and to use it only to decide on and use the service. This does not cover things that are public, that you already knew, or that you are legally required to disclose (tell us first if the law allows). This obligation continues after your account ends.
9. Your feedback
If you suggest an idea or an improvement, we may use it freely, without paying you and without crediting you, and it does not become yours. We appreciate it either way.
10. Not going around us
During your agreement and for twelve months after it ends, you agree not to use what you learned from BossHours to set up, fund or work for a business that copies the service, and not to pass our trade-specific content, templates or setup work to someone else to recreate it. Ordinary use of your own data after you leave is, of course, yours.
11. If this agreement is broken
We may suspend or end your access if you break these terms, do not pay, or put the service or other people at risk. Because copying or leaking what we built could cause harm that money cannot fully repair, you agree that we may ask a court for an injunction (an order to stop) in addition to any other remedy, without having to prove actual loss to get started.
12. Warranties and limits
We work hard to keep the service running and accurate, but it is provided “as is.” It is a business tool, not legal, tax, licensing or safety advice; check the details that matter to your trade and your state. Prices, codes and estimates the software suggests are suggestions you review. To the fullest extent the law allows, we are not liable for indirect or consequential losses such as lost profits, and our total liability for any claim is limited to what you paid us in the three months before the claim. Nothing here limits liability that the law does not allow to be limited.
13. Law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute is heard in the state or federal courts located in Florida, and you agree to their jurisdiction. Please contact us first; most problems are settled with a conversation.
14. Changes, and what keeps going
We may update this agreement. When the wording changes in a way that matters we publish a new version and ask you to agree again before you continue. Sections 5 to 13 (your data, what stays ours, what you agree not to do, confidentiality, feedback, not going around us, breach, limits, and law) continue after your access ends. If a part of this agreement is found unenforceable, the rest still applies. This is the whole agreement between you and BossHours about the service.
15. BossHours account texts (SMS)
Program: BossHours account texts to our subscribers (contractors). Message types: sign-in notices, setup help, and billing or renewal notices. Nothing else, and never advertising. You agree by ticking the optional, unticked box next to your mobile number on our sign-up form. Message frequency varies, usually a few a month. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help, or email support@getbosshours.com. Consent to texts is not a condition of purchase. Your mobile information will not be sold or shared with third parties for promotional or marketing purposes. More at /sms-opt-in.
16. Texts sent by your contractor (about a job)
When a customer books through a contractor that uses BossHours, the contractor may text them, from the contractor’s own business number, about that job only: a link to upload job photos, an arrival time or “on my way” notice, a question about the job address, and booking confirmations. These texts are never advertising. The customer agrees by ticking a separate, unticked box when they book from the contractor’s page, or by saying yes when the AI phone assistant asks if it may text a photo link. Message frequency varies with the job. Message and data rates may apply. Reply STOP to stop texts, or HELP for help. Consent to texts is not a condition of booking or buying. Sample messages and the exact STOP and HELP replies are on /sms-opt-in.
17. AI phone answering and our service providers
Calls to a business that uses the BossHours phone assistant may be answered by an AI assistant. The caller is told at the start of the call that it is an AI assistant and that the call may be recorded and transcribed so the business can book the job and keep an accurate record. A caller who does not want that can say so, and the call is passed to the business owner or voicemail. BossHours uses Telnyx as the telephone and text-message carrier for business numbers, calls and texts, and other service providers to run the software, as described in the Privacy Policy.
18. GPS Addendum (only if you use the GPS add-on)
This addendum applies only to businesses that buy and turn on the optional GPS vehicle-tracking add-on, and you accept it again when you activate it. In it, "Device" means a tracker plugged into a vehicle, and "Customer" means the business using BossHours.
S1. Company vehicles only, lawful use. You may use a Device only in vehicles you own or lease. You must not install or use a Device on an employee-owned or personally owned vehicle, or on a phone. At activation you confirm, by ticking a box, that each vehicle is owned or leased by you. You promise that you have given every driver written notice and hold their signed acknowledgment before location is shown or recorded, that you have posted any notices the law requires, and that you will not use the service for stalking, harassment or anything unrelated to running your business. Laws that may apply include N.J.S.A. 34:6B-22 (New Jersey), Conn. Gen. Stat. 31-48d (Connecticut), N.Y. Civil Rights Law 52-c (New York), 19 Del. C. 705 (Delaware), 26 M.R.S. 620-A (Maine), California Penal Code 637.7, California Labor Code 1560-1565 and the California Consumer Privacy Act. You are responsible for following the law in every state where your vehicles are garaged or driven.
S2. Our tools are not legal advice. The notice and acknowledgment templates are a convenience, not legal advice. We may switch off location display for any driver who has no recorded acknowledgment. In the BossHours app, each driver is shown at the top of the notice: "The TRUCK is tracking you, not the BossHours app. The tracker is plugged into your company's vehicle and reports where that vehicle is while you drive it. The BossHours app does not track your phone." The app does not collect phone GPS for this add-on.
S3. No personal vehicles or phones. See S1. There are no exceptions.
S4. Off-duty privacy. Privacy Mode stops tracking outside the working hours you set, including for take-home vehicles. Any exception (theft recovery, emergency, legal requirement) needs a written reason, is logged, and the driver is told.
S5. Prohibited uses. You must not use location data to watch bathrooms, break or lactation areas or anyone's home; to watch protected union activity; to guess at emotion, health or other protected traits; to set up geofences at health-care facilities; or to sell or share location data.
S6. Alerts are information, not decisions. You must not discipline or fire anyone based only on an automated alert. A person must review it first.
S7. Pay and hours. Location data can show time that counts as paid work. BossHours never changes timesheets by itself. You remain responsible for paying all hours worked.
S8. How we handle the data. For location data we are your service provider (processor). We do not sell or share it, use it for anything outside the service, or combine it with other data, as required for service providers under California law (Civil Code 1798.140(ag) and 11 CCR 7051). We help you answer access and deletion requests, tell you if we cannot comply with a request, and bind our subprocessors to the same terms.
S9. Retention. Raw location points are kept 90 days and trip and timesheet summaries 36 months, unless you choose another period. After the agreement ends we export your location data on request within 30 days and delete it within 60 days.
S10. Security. Location data is encrypted, access is limited by role and logged, and we tell you of a security incident affecting it within 72 hours. See Security.
S11. Your responsibility. You will pay for and defend us against claims caused by your failure to give required notice, get required acknowledgments or use the add-on lawfully.
S12. Connectivity. Devices use third-party mobile networks. Coverage is not guaranteed, network changes or shutdowns may stop a Device from working, and you must follow the carrier's acceptable-use rules.
